In response to inquiries regarding coverage for policies including, but not limited to, business interruption and civil authority with respect to losses as a result of COVID-19, we strongly encourage any business that experiences a business interruption and/or loss of income to promptly report their claim(s).
This is an unprecedented time and we are sharing guidance in attempt to educate and inform our clients. This is neither an attempt to deny, interpret, or render a coverage decision on behalf of the insurance company. All claims decisions will be left to the discretion of the insurance company and depend on specific facts and policy language.
However, the consensus among most insurers is that coverage for business interruption and loss of income stemming from diseases or illness of a contagious nature like COVID-19 will typically not be covered.
While there is little evidence to support coverage, we are not discouraging our clients from reporting their claims. The following guidelines should be considered in preparation for making a claim to support your loss. Regardless of coverage decisions, this may be helpful documentation in the event that disaster relief funding becomes available. Please see below:
1. Considerations for documenting loss of business related to this pandemic. This could include the following:
• Hotel room cancellations
• Meal reservation cancellations
• Private event cancellations
• Conference cancellations
• Any business and revenue loss associated with the pandemic
2. Below, are examples of documentation you may be required to present as evidence of loss and/or emergency declarations:
• Dates & records for all losses related to COVID-19
• Monthly sales history for the past two years
• Accurate year-end business financial statements (both income and balance sheets)
• As time transpires, interim month-end statement may also be required
• You will need to show a downturn in sales from prior periods (exact details unknown at this time) –early application may be premature
